■ Test results and how to receive them ・A confirmation URL will be sent to the email address you registered at the time of booking. Enter your date of birth to receive your verification code. You can check the PDF (original) of the result certificate. (※Results will not be sent by post. Reissuance of test results is not available.) ・Influenza result reports will be sent separately from a dedicated address.
This Terms of Use sets forth the terms of use and other matters concerning use of the PCR test booking website “Team Booking” (the "Website"), which are applicable to users of the Website ("User" or “Users”).
Article 2 Scope of Application
1 This Terms of Use shall apply to use of the Website operated by the administrator of the Website ("Administrator").
2 In the event that there are any additional consents Administrator may separately require from Users or warnings or other notices to be published by Administrator ("Notices"), such Notices shall be incorporated into and constitute part of this Terms of Use.
Article 3 Agreement to Terms of Use
1 A User must use the Website in accordance with this Terms of Use, and may not use the Website unless the User agrees to this Terms of Use.
2 Upon its commencement of use of the Website, the User shall be deemed to have agreed to this Terms of Use and the privacy policy concerning use of the Website separately provided by Administrator ("Privacy Policy").
Article 4 Scope of Services
1 Administrator will assist Users with executing an agreement (the "Certification Agreement") with medical institutions using this Website (”Medical Institutions”) and provide related services, in order for Users to smoothly obtain certificates of test results (“Test Certificates”) after undergoing nucleic acid amplification tests, antigen tests and/or other tests for infection with SARS-CoV-2 (collectively “Tests”) that meet the requirements of the country of destination .
2 Administrator shall not be held liable for execution and/or performance of any Certification Agreement, any determination made by Medical Institutions, any trouble or dispute between Users and Medical Institutions, or any other similar matters.
3 Administrator will provide Test Certificates registered by Medical Institutions in either of the following manners:
(a) transmission to MySOS application provided by Allm Inc; or
(b) displaying the Test Certificate in a PDF format on the Website.
Users may check the Test Certificate either on the "MySOS" app or on the Users’ personal booking page on the Website.
4 In facilitating execution of Certification Agreements, Administrator makes efforts to improve the transparency and fairness of activities by Users and Medical Institutions through providing for the following clauses:
(a) requirements and prohibited acts in Article 5; and
(b) suspension of use as in Article 6.
Article 5 Requirements and Prohibited Acts
1 Upon its use of the Website, a User shall comply with the following requirements:
(i) to properly provide Administrator with required information when using the Website;
(ii) to confirm, prior to execution of any Certification Agreement with a Medical Institution, testing methods and other conditions that meet the requirements of the country of destination as well as the conditions pertaining to Test Certificates offered by Medical Institutions; and
(iii) to immediately respond to inquiries or requests from Administrator or Medical Institutions regarding the Certification Agreement.
(iv) to promptly cancel or modify the Certification Agreement if and when the User cancels its travel to the country of destination or the User otherwise no longer needs to execute the Certification Agreement.
(v) to appropriately respond to matters that require responses from Users upon execution of a Certification Agreement with Medical Institutions, in addition to the preceding items.
2 A User shall not engage in any conduct that falls under or is likely to fall under any of the following upon use of the Website.
(i) to register false or incorrect information upon its use of the Website;
(ii) to execute a Certification Agreement (a) by misrepresenting that the User plans to travel without any actual travel plan, or (b) even though the User is unlikely to actually travel;
(iii) to execute a Certification Agreement with a misrepresented intent or to execute multiple Certification Agreements per trip;
(iv) to assign rights and duties relating to its Certification Agreement to any third party with or without consideration; or
(v) to act in breach of this Terms of Use or laws and/or regulations, or to conduct any act against public order.
Article 6 Suspension of Use
1 In the event Administrator deems that a User has committed any of the prohibited acts set forth in paragraph 2 of the preceding article, Administrator may, in its sole discretion, suspend use of Website by such User without prior notice.
2 Administrator may, if it deems necessary, disclose the reason for the suspension and other relevant information in the event of the suspension set forth in the preceding paragraph.
Article 7 Restrictions on Available Time and Use
In principle, the Website is available 24 hours a day, 365 days a year. However, some features of the Website may not be available due to Administrator management or other reasons.
2 Administrator will be entitled to restrict a User’s use of the Website after giving prior notice to such User in the event that any of the following conditions apply, provided, however, that in the event of an emergency, use of the Website may be restricted without prior notice.
(i) for scheduled maintenances of operation equipment for the Website and/or other facilities;
(ii) if and when services from Telecommunications Carriers' Services are not available;
(iii) in the event of a natural disaster, disturbance or other emergency or in the event of a serious failure related to the operation of the Website; or
(iv) in the event Administrator otherwise determines that use of the Website needs to be suspended.
Article 8 Intellectual Property Rights
All intellectual property rights, including copyrights and know-how contained in any program provided by Administrator to Users remain the sole property of Administrator.
2 Users shall use all programs and other copyrighted works provided by Administrator in connection with use of the Website in accordance with the following:
(i) to use only for the purpose of using the Website in accordance with this Terms of Use;
(ii) to not commit acts that could result in infringement on intellectual property rights, including reproduction, modification, editing, distribution and reverse engineering;
(iii) to not lease to, transfer to, or create any security interests for the benefit of any third party, whether for profit or not.
(iv) to not delete or modify copyright or trademark notices attached by Administrator
Article 9 Personal Information
1 Administrator will handle personal information obtained from Users through their use of the Website and similar information ("Personal Information") in accordance with Privacy Policy.
2 Administrator will not use Personal Information for any purpose other than the purposes of use set forth in Privacy Policy or not provide Personal Information to any third party except in accordance with the Act on the Protection of Personal Information (Act No. 57 of 2003, as amended) or other laws and/or regulations, or as required in judicial proceedings including litigation, provided, however, that statistically processed information may be disclosed.
Article 10 Disclaimer
1 Administrator (including the contractors retained for operation of the Website; hereinafter the same shall apply in this Article) shall not be held liable for any damages in any of the following, except where caused by Administrator’s intentional act or omission or by its gross negligence:
(i) information provided by Administrator, including Test and other requirements of the country of destination;
(ii) matters relating to the Website and other systems provided by Administrator; or
(iii) modification or cancellation of Certification Agreements and related matters due to medical reasons, requests from the national or local governments, or other unavoidable circumstances.
2 Administrator shall not be held liable for any damages suffered by a User as a result of any matter beyond the scope of services set forth in Article 4 or any matter not attributable to Administrator (including, but not limited to, any of the following):
(i) if a User has failed to promptly notify Administrator of any correction or change in information provided by such User to Administrator;
(ii) if any Medical Institution has divulged or leaked Test Certificates;
(iii) in the event of a failure in hardware or other facilities managed by Administrator due to natural disasters including earthquakes, volcanic eruptions, tsunamis, typhoons, or force majeure including fires, blackouts, or suspension of public service institutions;
(iv) in the event of defects, failures, or other troubles with the software, hardware, network, or other facilities used by a User, or in the event of misoperation or misuse by a User or any other reasons attributable to a User;
(v) in the event a User is in breach of this Terms of Use; or
(vi) any damages suffered by a User due to an event outside the scope of the services set forth in Article 4, damages not attributable to Administrator, or damages caused by force majeure, in addition to events or causes set forth in the preceding items.
Article 11 Amendments to Terms of Use
1 Administrator may, in its sole discretion, amend the Terms of Use without prior consent of Users.
2 Administrator shall, in the event of any amendment as set forth in the preceding paragraph, (a) publish such amendments on the website as separately designated by Administrator from time to time or (b) notify Users of such amendments, and the revised Terms of Use shall become effective from the earlier of either (a) or (b).
3 If a User uses the Website after publication of the revised Terms of Use, such User shall be deemed to have agreed to the revised Terms of Use at the time of such use.
Article 12 Governing Law and Jurisdiction
1 This Terms of Use and all matters relating to use of the Website shall be governed by and construed in accordance with the laws of Japan.
2 Any and all disputes between Administrator and any User arising out of or in connection with use of the Website shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
3 Notwithstanding the preceding paragraph, Administrator and a User shall consult with each other in good faith to resolve any matter not provide herein or any doubts or controversies arising with regard to the interpretation of this Terms of Use.
Supplementary Provision
This Terms of Use shall take effect on July 15, 2021.
Team Booking Privacy Policy
Article 1 Principle
In order to ensure smooth operation of the PCR test reservation website “Team Booking” (the "Website"), Administrator will acquire personal information from Users and medical institutions using the Website (“Medical Institutions”) to the necessary extent. Administrator will properly handle the Personal Information so acquired ("Personal Information") within the scope of the purposes of use set forth in this privacy policy (this “Policy”).
Article 2 Scope of Application
1 This Policy shall apply to the handling of Personal Information obtained in operation of the Website and shall be construed as part of, and together with, the terms of use for the PCR test reservation website separately provided by Administrator ("Terms of Use"). Except as otherwise defined in this Policy, capitalized terms shall have the meanings as defined in the Terms of Use.
2 If a User or a Medical Institution agrees to the Terms of Use, it shall be deemed to have agreed to this Policy.
Article 3 Scope of Personal Information to be Acquired
1 Administrator will acquire the following information from Users:
(i) name, address, telephone number, mail address, date of birth, and passport number;
(ii) country of destination, date and time of travel; and
(iii) information that a User enters into the system of the Website (the "System"), domain name, IP address, and other information concerning access to and use of websites related to the Website, in addition to the preceding items.
2 Administrator will acquire the following information from Medical Institutions:
(i) name and location of Medical Institutions;
(ii) name, telephone number, and e-mail address of the person in charge on behalf of Medical Institutions;
(iii) account information, test date, and test location of Users to whom the Medical Institution is to perform the test to issue the Test Certificate;
(iv) contents of the test notice or Test Certificate concerning Users tested by the Medical Institution; and
(v) information that a Medical Institution enters into the System, domain name, IP address, and other information concerning access to and use of websites related to the Website, in addition to the preceding items.
Article 4 Purpose of Use
Personal Information set forth in the preceding article shall be used only for the following purposes, in order for safe and smooth operation of the Website:
(i) to register and identify accounts on the Website;
(ii) to assist Users with executing an agreement with Medical Institutions concerning Test Certificates ("Certification Agreement");
(iii) to provide, maintain, protect, review and improve services by the Website, and analyze and publish information on the status of use and other similar matters;
(iv) to make notices, communications and announcements concerning the Website as well as to respond to inquiries and similar communications concerning the Website, and to provide information concerning use of the Website;
(v) to address acts in violation of the Terms of Use or laws and/or regulations; and
(vi) to conduct any act related to any of those listed in the preceding items.
Article 5 Restriction on Use and Provision of Personal Information
1 Administrator will provide Personal Information acquired from a User upon its execution of a Certification Agreement to a Medical Institution who becomes party to such Certification Agreement.
2 Administrator will not use Personal Information for any purpose other than the purposes of use set forth in this Policy or not provide Personal Information to any third party except in accordance with the Act on the Protection of Personal Information (Act No. 57 of 2003, as amended, and hereinafter the “Act”) or other laws and/or regulations, or as required in judicial proceedings including litigation, provided, however, that statistically processed information may be disclosed.
3 If and when the handling of all or part of Personal Information acquired by Administrator is entrusted to any third party (“Contractors”), Administrator will exercise due care in selection of such Contractors and will make reasonable efforts to exercise the required supervision over, and to properly manage, such Contractors. The same shall apply to cases where such Contractors entrust the handling of all or part of Personal Information to any third party.
Article 6 Safety Measures
1 Administrator shall take necessary measures to properly manage the Personal Information, including to prevent leakage of, loss of, or damage to such Personal Information.
2 Administrator will only store and maintain the Personal Information to the System for such period of time as required.
3 Administrator will respond appropriately to requests for disclosure, correction, deletion, suspension of use, or any other request a User is entitled to by laws and/or regulations in accordance with the Act and other laws and/or regulations.
Article 7 Allm Privacy Policy
In addition to this Policy, the privacy policy of Allm Inc. (https://www.allm.net/privacy-policy/) shall apply to the handling of Personal Information acquired in operation of the Website, to the extent that it does not contradict or conflict with this Policy or Terms of Use.
Article 8 Amendments to this Policy
Administrator may amend this Policy from time to time. Users will be notified of any amendment to this Policy in the manner set forth in the Terms of Use.
Article 9 Inquiries
For inquiries regarding the handling of Personal Information related to use of the System, please direct your communication to the contact announced on the Website.
Supplementary Provision
This Policy shall take effect on July 15, 2021.
